WP 3.6.1, bbP 2.4.
I’ve been trying/looking for a few hours for a solution; I can’t set the visibility of a forum to anything other than public. Modes an paternity seem to be working correctly.

This is a known issue on forum visibility, details are in ticket #2408 and a possible workaround is in this thread
