I get this issue no matter what, regardless of who I’m logged in as. It’s not an issue of trying to post too fast. This will happen if you’ve never posted at all. Tried with different users, different browsers. And I’ve tried setting the throttle to 60s, 30s, and 10s.

empty the setting and the check should not happen

It just defaults back to 10 when you remove all and save… Doesn’t that defeat the purpose?
