Strange Visibility issue

I have a category set to visibility:private and have 5 forums under this category which 4 of them are set to hidden and 1 is set to private.
So from the above settings, a user with participant role should be able to get to the private forum but this does not work. They can’t even see it.
Is anyone seeing this issue?
